These Membership Terms and Conditions of Service (“Terms”), together with our privacy policy available at https://bullseyeautospa.com/, govern your purchase of and membership in Our Unlimited Wash Club, which provides car washes as more particularly described in these Terms. The Terms are between you and Bullseye Auto Spa LLC, located at 10024 Lee Vista Blvd Orlando, FL 32829, United States (“Company”, “we”, “our” or “us”).
These Terms include a mandatory agreement to arbitrate in Section 12, meaning you agree to submit any dispute related to your membership or Services to binding individual arbitration rather than proceed in court. You also have a 30-day opt-out right detailed below.
These Terms also include a class action waiver in Section 12, meaning you agree to proceed individually with any dispute and not as part of a class or group action.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PURCHASE A MEMBERSHIP OR USE THE SERVICES.
OVERVIEW OF SERVICES Our Unlimited Wash Club allows you to keep your vehicle clean all month long. We offer membership plans at our location including Diamond, Gold, Silver, and Basic (“Services”). Specific service details and fees are available on-site and online. We reserve the right to modify membership plans or fees at our sole discretion, provided that material changes or fee increases take effect thirty (30) days after posting at our location and on our website. Services may vary due to weather, maintenance, holidays, upgrades, governmental orders, or force majeure events. A paid membership allows unlimited car washes for the identified vehicle at our location.
AUTO-RENEWAL Your membership begins with providing a valid debit or credit card (“Payment Method”) and your acceptance of these Terms. Your Payment Method will be automatically charged monthly until cancelled by you or terminated by us. You may cancel your membership without penalty by following procedures detailed in Section 5 below.
YOUR ELIGIBILITY; YOUR RESPONSIBILITY You represent and warrant that you: (i) are at least 18 years old; (ii) are eligible to use the Services; (iii) will provide accurate information; (iv) have the authority to enter into these Terms; and (v) will not violate rights of others. Users under 18 must use a parent or guardian’s account.
MEMBERSHIP REQUIREMENTS Communication. Account-related communications will be electronic via email or text to your provided contact information.
Accuracy. You must provide true, current, and complete information and promptly update it as necessary.
Privacy. You agree we may collect and use your personal information as detailed in our Privacy Policy at https://bullseyeautospa.com/.
Text Messages. We may communicate via text, with standard carrier charges applying. You may opt-out at any time by texting STOP.
Membership. Membership is valid for one personal, non-commercial vehicle. Membership cannot be transferred or resold. Commercial vehicles (e.g., ride-sharing, taxis) are excluded. Protect your account by keeping credentials secure and notify us immediately of unauthorized use.
BILLING, CANCELLATION, AND REFUNDS Payment. Your monthly membership fees will be automatically charged to your Payment Method. Declined payments may suspend Services until resolved.
Billing Cycle. Your monthly charge date aligns with your initial sign-up date.
Updating Payment Method. Update via website or at our location.
Cancellation. Cancel at least 7 days before renewal via website or at our location to avoid further charges. Services continue until the current billing cycle ends.
No Refunds. Membership fees are nonrefundable.
ACCEPTABLE USE POLICY You agree not to engage in prohibited acts including impersonation, interference with Services, unauthorized recordings, or unauthorized use of automated technology on our website.
RIGHT TO RESTRICT OR TERMINATE ACCESS We reserve the right to refuse, suspend, deactivate, or terminate membership or Services at our discretion without liability.
DISCLAIMER OF WARRANTY Services are provided “AS IS” without warranties. We expressly disclaim liability for specific vehicle damages including antennas, mirrors, non-factory accessories, and pre-existing conditions.
CLAIMS PROCESS Claims for alleged damages must be submitted in writing within 30 days of occurrence to our onsite manager at 10024 Lee Vista Blvd, Orlando, FL 32829. Determinations of claims are at our sole discretion.
LIMITATION OF LIABILITY Our cumulative liability shall not exceed the amount you paid in the previous three months or $100, whichever is greater.
INDEMNITY You agree to indemnify us against claims arising from your use or violation of these Terms.
AGREEMENT TO ARBITRATE & CLASS ACTION WAIVER Disputes will be resolved via binding arbitration under AAA rules in Orlando, FL, governed by Florida and federal arbitration laws. You may opt-out within 30 days by notifying us in writing at our address.
CLASS ACTION WAIVER You waive the right to participate in class or group actions against us.
MISCELLANEOUS These Terms represent the entire agreement. Changes to these Terms will be posted online and effective upon posting. Continued use after changes constitutes acceptance.
